Loudness Check terms of use

These terms apply to Loudness Check, an app for ChatGPT published by Haiden McGill ("we", "us"). By using it you agree to them. Your use of ChatGPT is also governed by OpenAI's terms.
What the app does
Loudness Check measures the integrated loudness, true peak and loudness range of an audio file and compares them with published targets for Spotify, YouTube, Apple Music, podcasts and EBU R128 broadcast. It can export a copy with a single gain change applied. It does not limit, compress, equalize or otherwise process your audio.
Measurements follow ITU-R BS.1770-4 and EBU Tech 3342. Platform targets are general guidance and can change; each platform decides how it handles your audio.
Your files
You must have the right to use any audio you check or export with the app. You keep all rights to your audio. We do not receive it, as described in the privacy policy.
No warranty
The app is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose or that the results will be accepted by any platform. Check important deliveries with your own tools before release.
Limitation of liability
To the extent the law allows, we are not liable for any indirect, incidental or consequential damages, or for any loss of data, revenue or opportunity, arising from your use of the app. In any case, our total liability for all claims relating to the app is limited to US$100.
Changes and availability
We may change, suspend or discontinue the app at any time. We may update these terms; continued use after an update means you accept the new terms.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute relating to the app will be resolved in the state or federal courts located in California, and you and we consent to their jurisdiction.
